The State Environment Impact Assessment Authority (SEIAA) is the state-level statutory body that grants Prior Environmental Clearance to all Category B projects under India's EIA Notification, 2006. Each state and Union Territory has its own SEIAA, constituted by MoEFCC on the recommendation of the state government. Composition and powers: A SEIAA has three members: a chairperson (typically a retired senior civil servant or technical expert of national standing) and two members (one from the central government and one nominated by the state). The members serve fixed three-year terms, extendable once. SEIAA is a decision-making body, not merely advisory — it issues the binding EC order, based on the technical recommendation of the State Expert Appraisal Committee (SEAC). Although SEIAA almost always accepts SEAC recommendations, it retains formal discretion to differ.

Procedural responsibilities: SEIAA receives applications through the PARIVESH online portal, refers them to SEAC for technical appraisal, and issues the final EC letter incorporating all conditions specified by SEAC. The Authority also handles renewal of EC, transfer of EC to a successor entity in case of project sale or merger, amendment of EC to reflect capacity expansion or product mix change, and compliance monitoring through six-monthly reports submitted by the proponent. Non-compliance triggers SEIAA to issue show-cause notices that can escalate to suspension or revocation of EC.

Relevance for Indian recyclers: Essentially every formal e-waste, plastic-recycling, tyre-recycling, or lithium-ion-battery-recycling project of normal commercial scale operates under an SEIAA-issued EC. The practical implications: SEIAA timelines vary significantly across states — Karnataka, Maharashtra, and Tamil Nadu SEIAAs are relatively well-resourced and clear well-prepared applications within 9-12 months end-to-end; smaller states can take 18-24 months. SEIAA also holds the authority to issue 'general conditions' or sectoral standard operating procedures that streamline appraisal for common project types. Smart recycling entrepreneurs review the relevant SEIAA's published track record and previous EC orders for similar projects before submitting their own application, to anticipate the conditions that will be imposed and budget the EMP capital and operating costs accordingly.
